Basic Law / Constitution



In the name of Almighty God!
The Newlandian People,
mindful of their responsibility towards creation,
resolved to renew their alliance to strengthen liberty, democracy, independence, and peace in a spirit of solidarity and openness toward the world,
determined to live together with mutual consideration and respect for their diversity,
conscious of their common achievements and their responsibility towards future generations,
and in the knowledge that only those who use their freedom remain free, and that the strength of a people is measured by the well-being of its weakest members;

adopt the following Constitution:

Domestic Affairs Article

1. The government shall protect any Citizen or region directly controlled by the region.
2. Every Member has the absolute right to free expression
3. Any form of racism, sexism, fascism, antisemitism, etc. is completely prohibited and shall be treated as high treason, resulting in a ban.
3. Any nation found to be associated with these groups will be expelled without a trial.

4. Any form of pornography, adultery, adult content, or other forms of such content is banned and is considered treason, resulting trial, not in favor of the guilty.
4.1-A All content posted must be kept below PG 13.
4.1-B Swearing is allowed, but it is expected from nations to keep it as limited as possible.

Foreign Affairs Article

1. There must be at least ten nations in the region.
2. It cannot also be labeled as 'fascist' or 'communist.'
2.1-A All further rules are in Embassy Factbook.
3. Any violation of these rules will result in a denied request and/or the closure of the embassy.
4. Only historical and diplomatic examples are permitted.

Government Article

1. Newlandian political system will be a presidential one.
2. Elections will be held to choose the Chancellor.
3. The Chancellor appoints the Interior and Foreign Ministers.
4. An RP minister is appointed by the interior minister.

Judiciary Article

1. The only legal court in Newlandia will be the Constitutional Court.
2. The court may appoint two additional judges who may hold political office to represent a wider range of viewpoints, but there will also be one Constitutional Court Justice who is wholly impartial and who will have the final say.
3. Any Bans need to go through Court approval.
4. The Constitutional Court will have the authority to invalidate any legislation if it is believed to be unconstitutional, but it must specify which specific provision is unconstitutional.
5. If legislation was passed in a referendum, the Constitutional Court cannot veto it.
6. Any government employee who engages in unconstitutional behavior may be fired by the Constitutional Court.
7. The government may remove a judge from the Constitutional Court if they are discovered to be biased or corrupt.
8. If the case is reversed, neither the government nor anyone else[1], may file a new lawsuit within two weeks.
9. On the third Wednesday of the month, the Governmemt elects a candidate for the position of Constitutional Court Justice. In consensus President and Ministers elect the Supreme Judge.

[1] Within or outside of the government. even if it involves a case against someone who has broken the law.

Ministries Article

1. Interior Ministry manages the home affairs.
2. Foreign Ministry manages external affairs and diplomacy.
3. RP Ministry manages Roleplay in Region. Ministry duties are organizing roleplay. (Map, GMs, Rules, and others)
The Minister of Interior chooses Minister for RP for a monthly term.

Electoral System Act

1. The first Monday of every month is election day.
2. Only people, who got citizenship of Newlandia can participate and vote in elections.
3. The Ministry for Interior assumes responsibility for conducting the elections.
4. The election is over when one of the candidates wins, receiving more than 50% of the votes.
5. If none of the candidates has received the required number of votes (>50%), the second round of voting is scheduled.
6. The second round is held the day after the first round.
7. The candidates who took the first and the second places in the first round of elections, participate in the second round.
8. Vote will be done in Secret. In an election or referendum, a voter's identity is kept hidden.

Protection of Democracy Act

1. Any nation attempting to overthrow the Regions Government illegally will face trial. If there is sufficient proof, the country will be banned.
2. The government may impose martial law, delaying elections and retaining total control for a maximum of two weeks.
3. The government may remove a judge from the Constitutional Court if they are discovered to be biased or corrupt.

Citizenship Act

1. For Citizenship, you must be in Newlandia for 5 consecutive days, list all of your other nations, state in which Regions you are / we're, and state if you had any problems with NS moderators.
2. Without citizenship, a person cannot vote in elections or run for office.
3. Newlandian Passport Holders will be protected internationally.

LGBT Act

1. It is illegal to discriminate against LGBT people.
2. LGBT people will be treated fairly.
3. It is illegal to promote LGBT discrimination.

2 Week Ban Act

1. The government will have the authority to ban anyone without judicial content for two weeks.
1.2 If a person is not found guilty, they must be automatically unbanned.
1.3 If a person is found guilty, he or she is barred for the time specified by the court.
1.4 A person has the right to appear in court.
1.5 If the trial is still ongoing, the individual may not be unbanned.

Parliament Restriction Act

1 For the parliament to successfully pass a law, a minimum 51% majority is needed.
1.1 For the parliament to successfully pass an unrepealable law, a minimum 75% majority is needed.
1.2 For the parliament to successfully edit the constitution, a minimum 90% majority is needed.
2 Any and all acts can be vetoed two times either by the President or the Father. If an act is vetoed, it will go into voting again. If the act is vetoed consecutively 4 times by both the father and the president, the act will no longer go into voting and be automatically repealed.
3 The President or the father are not eligible for voting.
