Consitution of the Monarchy of The Monarchy alliance

PREAMBLE
In order to create a fair, just, and safe region for all its citizens, this document serves as the foundation of the laws of The Monarchy alliance. It in addition sets its goals as follows:
To provide for the common goals of The Monarchy alliance regarding the military, to ensure equal justice for all, to ensure a safe environment for all, to ensure a fun roleplay for all.

(PROPOSED):
Bill of Rights,
1. Each citizen shall be granted the right to speak out against the goverment in a constructive form that is complicit with the rules of nation states. Treason is not allowed, but constructive dissent is. As an example, "The Foreign Secretary should have not have opened embassies with [region name], because of their vile history...."
This is acceptable, and in fact encouraged. Something that is not acceptable is,
"The Foriegn Secretary is so stupid for opening emabssies with [region name]. DUM DUM!"
This is said gross conduct and will not in any circumstances be tolerated.

2. Each citizen shall be afforded the right to a fair trial, unless there should be a national emergency in which case threats can be immediately banned. A citizen shall be afforded legal counsel, should they choose to accept it. A citizen can be given punishment without trial if they without cause do not appear to their trial.

3. Every citizen shall be afforded the right to rolepaly, if they do not loss such privileges temporarily due to breaking the law and being duly prosecuted and sentenced. Each citizen shall be allowed to open their own roleplay, should it be complacent with nation state rules.

4. Every citizen that is not currently serving a sentence barring them from doing as such, may vote in elections.

5. Every citizen may run for public office.

6. Every citizen shall be protected from being discriminated against their religion, sex, and race.

7. All political ideologies are not to be infringed upon, however Nazism and facism is never to be tolerated.

8. Nations when speaking in their public offices, (such as a senator in the Senate house, or a chancellor asking questions in his office), may if they choose so, be called by their full titles. (Right Honorable Senator .....)

9. The press shall be permitted to speak their minds, and voice their options should they be without slander (if so, that will be prosecuted), without punishment.

10. Every citizen shall have the opportunity to prusue happiness, and success whithin the region, and that sacred right shall never be infringed upon.

11. This document reconizes that as time passes, it is nesseary for laws to change as well, and allows for this bill of rights to be amended with a majority in the Senate, and a 2/3 public poll.

12. This amendment is not a law to be followed, but is a precedent that is preferable to be followed. It is preferable for the Emperor to not (except when nesseary), actively endorse a party, (voting is encouraged.) It is preferable, for an Empeor to conduct himself with the upmost dignity. It is preferable, that a Senator be active, and write legislation to better the region. It is preferable for a senator to conduct himself with the upmost dignity, and be a model for other nations. It is preferable, for the Senate and the chancellor to attempt to compromise in legislative matters, for doing such shall further the cause of the ultimate common goal, which is bettering the region. It is preferable, for the Chancellor to conduct himself respectfully. It is preferable, for the chancellor to not use the powers of his executive orders excessively, except when necessary. It is preferable, for the ministers of the Chancellors Cabinet, to diligently advise and help the chancellor in his burden. It is preferable, for ministers to actively help nations in the region. And finally, it is preferable, for all nations in this region, to conduct themselves in the upmost regard to their fellow nations, and treat each other kindly. It is preferable, for all nations to conduct themselves with honor.

Article One: Legislative Branch:
Five senators shall be elected every month to make up the grand Senate.

Each senator is to serve a full term, unless they are removed by impeachment, found guilty of a high crime, or willfully resign.
The requirements to be a senator are:
1. Be a citizen for two weeks (struck null and void in the case of a merger)
2. Never be convicted of treason or another high crime
3. Swear allegiance to the Emperor, His Majesty, Holy Roman Empires2, and the people of The Monarchy alliance.
4. Be on the TMA official discord

A senator shall be addressed as the Right Honourable (name)

Term limits:
There are no direct term limits, however a Senator may only serve two consecutive terms at a time, followed by two full terms of not serving in the Senate.

Duties of the Senate:
1. Pass a budget for The Monarchy alliance every month.
2. Pick a member among themselves to be the Speaker of the Senate
3. Conduct the voting to either pass a bill, or leave it dead from one of the lower houses.

The chancellor, and the Emperor may propose bills

Powers of the Senate:
1. Proposing bills with a majority vote. Each bill passed must be signed by the Chancellor, with vetoes being overrides with a 4-1 majority. The Emperor may also veto, with the same overriding rule on legislation, however should both the Chancellor and Emperor veto it may not by overriden by the Senate
2. Voting on Bill's
3. Approving on decrelations of war, or peace treaties.
4. Power to remove any minister with a minimum 4-1 vote
5. Power to remove a Justice with a minimum 4-1 vote.
6. Commending, or condemning regions (not war) with a simple majority.
7. Approving the Chancellor's nomination for Justice with a simple majority

Note:
The budget of The Monarchy alliance may only be proposed by the Chancellor. The budget shall not have to be approved by the two emperors.

Article Two:
The Crown

Two: Executive Branch:
The executive branches sole leader is His Excellency the Chancellor, dutifully assisted by his cabinet.

Term limits:
His Majesty, the Emperor Holy Roman Empires2 an serve for life, except for when the Emperor is on vacation, in which case he may temporarily grant executive power to another nation, excluding banning and kicking, or abdicates.

The Emperor has a duty to run the roleplay, maintain the integrity of his office, create any further imperial offices he sees fit, and run recruitment.

His majesty the Emperor Holy Roman Empires2 must approve the Chancellors picks for Minister of Foreign affairs, and Minister of Home Affairs. His majesty, the Great Emperor Calibert must approve the chancellors pick for Minister of Justice, and Minister of Defense.

National Emergency Clause:
The founder Holy Roman Empires2, may declare a national emergency in a mass exodus, or any other time that the two Emperors see declaring a national emergency fit. This power is to be used sparingly. In the case of a national emergency, the founder will take control of the region, and have broad powers, in a dire emergency. A national emergency may be lifted by the founder, or the Senate with a majority vote.

His Majesty, the Emperor Holy Roman Empires2 will have sole management over the roleplay, and shall appoint whoever he sees fit, with it being recommended he appoint a minister of roleplay

His Majesty, the Emperor Holy Roman Empires2 shall reserve the right to appoint, promote and dismiss junior officers, to serve the duties he sees fit.[/box]

Article Three: The Chancellorship

The Chancellor, elected every thirty days and bound to a two term term limit shall serve as the executive head of the the Goverment of The Monarchy alliance, and hold the title His Excellency.

The Chancellor shall appoint his cabinet, to be approved by the Imperial Senate.

The Chancellor shall run the government along with his cabinet serving at His Excellency's pleasure.

All Bill's passed by the Imperial Senate must be signed by the Chancellor, and the Chancellor reserves the right to veto any motion passed, however refering to article two unless the veto is joined by the Emperors veto it may be overriden 4-1.

The Chancellor may, at any time for any reason dismiss a minister.

The Chancellor reserves the right to appoint justices, however without the approval of the Imperial Senate there may only be one.

Article Five: The Judicial Branch
The Judicial Branch will be composed of two justices, appointed by the Chancellor and approved by the Senate

1. The justice will oversee fair trials on all citizens who stand accused of crimes.

2. The justice has to provide a lawyer to the defendant accused.

3. The justice has to allow for the defendant to challenge every piece of evidence, and cross examine the prosecutions witness, as the defender and his lawyer so please.

4. The justice must find a ruling, as guilty, or not guilty, and provide a brief statement on his ruling, to be archived.

Justice Apoointment and Removal:
1. The Senate, with a majority vote, may appoint a justice

2. The Senate may remove a justice with a minimum 4-1 vote

Trial process:
1. There will be a hearing on the case, where the defense may move for dismissal of the case, and the jusitce may either grant, the dismissal, ending the case immediately, or deny that.

2. In the hearing, the prosecution or defense may ask to recuse the justice, on counts of bias, conscious or unconscious, and then the two emperors will decide whether the justice shall be recused. If the emperors decides that the justice cannot serve on the case, he shall take the role of justice. If the Emperors are split on the decision, the Justice stays to precide over the case.

(NOTE: Openings are optional for each side, and each side can choose weather to submit an opening for the trial.)

3. The prosecution will list, and then call its witnesses for the trial.

4. The defence will cross examine the prosecutions witnesses for the trial.

5. The defence will list, and then call its witnesses for the trial.

6. The prosecution will then cross examine the defences witnesses for the trial.

7. The prosecution will submit its evidence.

8. The defence will counter the evidence.

9. The defence will submit the evidence.

10. The prosecution will counter the evidence.

11. Both sides will submit closings.

12. The justice will give his/her ruling, and then release a short statement to be archived.

Appeallate Proecess:
1. A defendant found guilty by the jusitce can appeal to the two Emperors, and if they accept the appel the trial process starts again, with one Emperor presiding, the evidence to be closely reexamined.

2. If a Emperor serves as the justice, then the other Emperor shall have the full powers in the appleate judicial process.

Article 6: Impeachment
1. Any goverment officials who the Senate has the power to impeach (see section 1), can be impeached with a minimum 4-1 Senate vote.

2. The Chancellor or Emperor are both barred from vetoing a motion of Impeachment.

3. Govemerment officials who the Senate has the power to remove can be removed for Treason, or other high crimes

Article 7: Citizenship:
1. Any citizen who is a member of the region, and discord for one week is a citizen, after applying and taken the oath of citizenship (see Oath of Citizenship Clause)
2. His Majesty, the Emperor Holy Roman Empires2, and all nations moving from a merger are automatically granted citizenship
3. A citizen of TMA may not have two nations with citizenship, and if so, will be barred from holding citizenship from 2-4 months again, and permanently after second of such an offence.
4. His Majesty, Holy Roman Empires2 can grant Honorary citizenship to any foreigners, who he feels have done a great service to monarchy of TMA

Rights of citizens:
1. A right to a fair trial
2. The right to vote
3. The right to appeal (the appeal must still be accepted, but non-citizens have no right to appeal)
4. The right to free speech (spam is an exception, and blatant lies)

Members clause:
Anyone not a citizen can be kicked from the region by His Majesty the Great Emperor Holy Roman Empires2, with a formal statement being released afterwards from the Emperor. If the Senate accepts the kick with a majority vote, then the member can be banned.

Oath of Citizenship Clause:
I (nation name) solemnly swear to serve His Majesty Holy Roman Empires2, His Majesty Calibert and dual monarchy of The Monarchy alliance to the best of my abilities, and additionally swear to never commit treason against His Majesty Holy Roman Empires2, His Majesty Calibert and The Monarchy alliance. I shall preserve, and protect the consitution of the Dual monarchy of The Monarchy alliance.[/box]

Article Seven: The Revision-Addition Clause
1. Every article, but article 2 (only with premission of the two Emperor) may be revised, and only revisions not contradicting withstanding laws will be upstanding in law.

Article Eight: The Ministries
1. Establishes the ministry of foreign affairs headed by the minister of foreign affairs. The minister of foreign affairs can appoint as many ambassotors as he sees fit, to be approved by the Chancellor. Appointed by the Chancellor, said appointment must be approved by his majesty Holy Roman Empires2(see section 2)

2. Establishes the home office, which archives all laws, elections, judicial rulings, ext, and monitors the regional message board, and can supres posts. He may also kick nations, but his decision must be upheld by a majority vote by the Senate. Appointed by the Chancellor, said appointment must be approved by his majesty Holy Roman
Empires2 (see section 2)

3. Establises the minister of rp, which is in charge of roleplay. Only His Majesty, Holy Roman Empires2 can appoint him, as he is soley in charge of the rp (see article 2)

4. Establishes the minister of defense, who shall if he sees it necessary create an World Assembly army of nations. Appointed by the Chancellor.

5. Establishes the minister of justice, who shall appoint lawyers, and oversee the criminal justice system. Appointed by the Chancellor, said appointment must be approved by both his Majesty Calibert(see section 2)

Criminal Codex:
Treason: The highest crime, and if found guilty, the defendant found guilty must be banned immediately, and scratched out of any public records, besides their own trial. Defined as: Betraying his majesty the Emperor, and The Monarchy alliance. A high crime

Abuse of Power:
A goverment offical abusing his power to his own gain in office, and punishments range from revoking citizenship for 1 month, to six months. If that certain goverment officals abuse of power is especially heinous, a year of citizenship revocation can be the punishment. If it is organized (2 or more government officials are involved), and the abuse of power is heinous, citizenship can be revoked for life, or the government official banned for one month. A high crime

Bribery:
Any type of quid pro quo, minor violations can go off with not being able to vote in the next election (citizenship is intact), to four month citizenship revolution. A high crime

Harassment:
Attacking someone, such as inflammory posts, or name calling. In minor cases, a defendant may go off with a warning, and in severe cases, two month citizenship revocation. If it continues, a citizen may be banned. A serious crime, but if repeated to the extreme, it becomes a high crime

Spam:
Repeated messaging, after being wanted 3 times by a govemrnent offical. A warning, to not being able to participate in events and rp. If the spamming is so repeated (this is to be the extreme), a citizen can be ejected (temporarily) . This is to be the extreme. A petty crime

Repeated breaking of rp rules:
Anywhere from a warning, to being banned for one month in government sponsored rps (you can rp with a friend still.) A petty crime

Other minor violations:
If, case by case, a minor violation not listed here is broken, and the minister of justice agrees it should be prosecuted, it shall be prosecuted. Ranges anywhere from a warning, to being stripped from being able to priaiticipate in the roleplay for a month. A petty crime.

Citizenship act in the Criminal Codex:
If someone has two citizen nations, they are to have their citizenship revoked for 6 months. 6 months is to be added for every additional citizen puppet.

Faicst clause:
Any proven fascist, including nazis can be immeaditly banned by the emperor or the home secretary. The emperor may reverse his, or the home secretaries decision. Whoever banned the fascist must provide a detailed written statement as to why they are banned.

Article Eight: Political Parties
Any citizen can create a political party

Section One:
~All citizens, including of dual monarchy of TMa-Leveler may create a political party, if they have a minimum of two members including themselves.

Citizens Are disqualified from creating a political party if they have;
1. Commited a high crime

2. Extreme repetition of a petty crime

Article Two: Removal of A Political Party
If the founder of a political party is found guilty in;
1. Committing a high crime

2. Extreme repetition of a petty crime
Then the party shall be removed. Its members are welcome to rejoin, and found new parties as they wish.

Article Nine:
This article officially establishes the Chancellorship. The chancellor election shall be held every month, and shall be open to all TMA-Leveler citizens of the Dual Monarchy.

The chancellor shall,
1. Be the Executive counter to the two Emperors to keep the balance of power.
2. Appoint ministers with the Emperors approval.
3. Appoint a justice, with the Senates approval.
4. Dismiss Ministers (excluding and brought upon by roleplay, such as minister of rolepaly), even without the Emperors consent.
5. Propose the budget of the Dual monarchy of Tma-leveler.

The Chancellor shall be addressed as, His Excellency, the right honourable (name)

Powers of the Chancellor:
1. Appointing Ministers with the proper procedure aforementioned in article 2 and article 9.
2. Executive orders (see executive orders act of 2020)
3. Appointing justices with the senates approval
4. The power to pardon the sentence of any citizen who committed a petty crime, or commute their sentence to the chancellors whim of conscious. The chancellor may commute the sentence of removal of citizenship by up to 2/3rds (someone sentenced to 3 months removal of citizenship can be commuted by the chancellor to 1 month). The chancellor can overturn the sentence of banning from running from elections entirely. The chancellor may not commute the sentence of those ordered to be banned from the region if they were convicted of treason, but if it is of another high crime, they can commute the sentence to a lifetime removal of citizenship.

Term Limits:
A chancellor can only serve two terms.

Executive Order act of 2020:
A chancellor can declare an executive order, regarding embassies, foreign relations, creation of a domestic or foriegn task force, millitary actions approved by the Grand Senate, and any contests and games excluding roleplay.
