Preamble

In the course of every region’s growth, it will always be found necessary to construct a commonwealth for the protection and improvement of the people. Thus, we, the people of the newly-reborn Nesapoli Republic, hereby affirm this constitution, promising to uphold both its word and spirit to ensure the prosperity of all our nations.

Article I - The Assembly

Section 1. The Assembly shall be the primary legislative organ of the Republic.

Section 2. The Assembly shall consist of all citizens of the Republic. The process for becoming naturalized as a Citizen of the Republic and thus a member of the Assembly shall be outlined through the use of legislation.

Section 3. All citizens of Nesapo at the time of this Constitution’s enactment shall be grandfathered in, and considered to be members of the Assembly.

Section 4. Any and all legislation must be approved by a majority of votes cast to become law.

Section 5. The Assembly may expel one of its own members and strip them of their citizenship by a two-thirds majority vote. A nation may not be stripped of its citizenship in any other way.

Section 6. The Assembly may impeach any government official, stripping them of their office, by a two-thirds majority vote.

Article II - The Delegate and Founder

Section 1. The Delegate shall serve as the Head of Government, and shall be tasked with faithfully executing all laws and legislation of the Assembly. The Delegate shall occupy the in-game office of Delegate, in order to dutifully defend and represent the Republic.

Section 2. The Delegate shall be elected by the Assembly in free, fair, and open elections held every three months, unless a snap election is called.

Section 3. No citizen may serve as Delegate for more than two consecutive terms.

Section 4. The Founder shall be the official Head of State for the Republic, and shall hold the in-game office of founder.

Section 5. The Founder shall serve permanently unless impeached or unless the Founder ceases to occupy the office of in-game founder. In either of these cases, the Founder shall be replaced by an official meeting of the Assembly for this purpose. In order to take office, a new Founder must be selected by a two-thirds majority.

Section 6. The Founder may dissolve the Cabinet and call for snap elections to begin within a week, should extenuating circumstances demand it.

Article III - The Cabinet

Section 1. The Cabinet shall serve to assist the Founder, Delegate, and Assembly in performing their official duties for the service of the Republic.

Section 2. The Delegate shall be head of the Cabinet and oversee its operation and smooth running.

Section 3. The Cabinet shall consist of the Delegate, the Founder, and any other positions established through an act of the Assembly to execute the laws of the Republic.

Section 4. Elections for all offices within the Cabinet shall be held concurrently with elections for the Delegate.

Section 5. Should there be a need, the Cabinet may by majority agreement submit a resolution calling for a constructive motion of no confidence in any of its members. Should the resolution be passed, the member shall be removed from office and replaced.

Section 6. The Cabinet may, by unanimous agreement, issue a declaration of emergency should extreme circumstances demand it. In the case that this should occur, the Cabinet may take whatever steps necessary to defend the Republic, so long as these actions violate neither this constitution nor any law of the Republic.

Section 7. The Cabinet shall be tasked with evaluating the constitutionality of any laws passed by the Assembly, and may strike down any laws found to conflict with this constitution.

Article IV - Specific Rights of the People

Section 1. All citizens of the Republic have inalienable rights which cannot be revoked. Because listing all rights in this constitution would be impractical and impossible, the government as a whole must act in order to protect all rights of the people, rather than simply those which have been enumerated here.

Section 2. All nations have the right to freedom of speech, except in cases where the speech has been determined to have no purpose other than to cause harm to others or poses a clear and immediate threat to the welfare of the region.

Section 3. Any nation may enter and leave Nesapo freely, unless that nation or its owner has been convicted of a crime, or a state of emergency has been declared.

Section 4. No nation shall be punished for a crime without first having been given a fair trial before the Cabinet in which they have received legal counsel and where the prosecution bore the burden of proof. This section shall not be construed in such a way as to deny the Founder or the Delegate the power to act in defense of the Republic when it is under imminent threat, such as when it is being attacked by foreign forces.

Section 5. Any and all nations punished for a crime by the Cabinet shall have the right to appeal their conviction to the Assembly, which may then reverse the Cabinet’s decision by a two-thirds majority vote.

Section 6. All nations have the right to hold positions and citizenship in other regions, so long as these regions are not engaged in a state of war with the Republic, or if these concurrent positions otherwise present a clear and serious conflict of interest.

Article V - Amending the Constitution

Section 1. Amendments to the Constitution may be presented to the floor of the Assembly by a majority vote of the Cabinet, or upon the signing of a petition by at least ten members of the Assembly.

Section 2. In order for an amendment to be added to the Constitution, it must achieve a two-thirds supermajority vote from the Assembly, at which point the amendment shall take effect.

Section 3. Purely cosmetic changes to the constitution, such as the renaming of offices or the creation of the theme, can be enacted as legislation by majority vote without the requirement of passing a full amendment.

This constitution was passed on 7 July 2016, with a vote of 9-1.
