Constitution of the Democratic Alliance (WIP)


THE DEMOCRATIC ALLIANCE




Preamble

It is in good faith and conscience, that on this day, July the Fourth of the Year 2015, The Democratic Alliance is hereby chartered and established by this Constitution.


The Founder of The Democratic Alliance


I: The Founder of this region is hereby endowed with executive oversight authority; the ability to change the region when needed, settle disputes and provide for the common defense.

II: The position of Founder is permanently held by Democratic alliance, and is irrevocable for as long as the Founder is in existence on NationStates.

III: The decisions made by the Founder can be overridden by a supermajority (2/3) vote of the Democratic Senate.

IV: In the event that the Founder ceases to exist on NationStates, the executive oversight authority shall be passed to the President-Justice until such time that the Founder returns, or other arrangements can be made by The Democratic Senate

V: The Founder is also responsible for conducting official elections in the event that the Premier cannot.


The Democratic Senate


I: The Democratic Senate is ordained as the legislative assembly of The Democratic Alliance, thereby being granted the authority to author, vote on, debate and pass resolutions into law.

II: The Democratic Senate shall compose of all official citizens, according to the Citizenship Dossier.

III: The Democratic Senate shall be lead and represented by an elected Speaker of the Senate, whom is responsible for bringing bills to the floor for vote, stating and standing for the interests of the Senate in sessions of The Executive Council, calling sessions of the Senate and managing overall Senate affairs, including, but not limited to, reporting the illegal/inappropriate conduct of senators and ensuring all resolutions are free of grammatical errors and illogical/illegal loopholes and clauses.

IV: The Speaker is required to pass all resolutions into law that reach the simple-majority threshold of approval from senators, although the Speaker is allowed to vote on bills. Resolutions are to be voted upon by referendum via regional poll.

V: In the event that the Speaker of the Senate is deemed incapable of performing the duties of the office, a 2/3 supermajority vote from the Senate can oust the Speaker, preventing them from serving as Speaker again. Afterwards, the President-Justice shall serve as interim Speaker until such time as the Senate can elect a new Speaker.

VI: The term-length of the Speaker of the Senate shall be 3 months. If an Interim Speaker is appointed, then they shall serve the remainder of the term from the previous Speaker.

VII: The Democratic Senate is invincible from dissolution, however, senators can be cast out if they are found guilty in court for violating Class II and/or Class III laws. The classes of laws define the severity and influence of the law, with Class I laws being lower-level and simple, Class II being mildly-influential and more complex, and Class III laws being of high-importance and extreme complexity. The classification of laws are to be decided upon collectively by the Speaker of the Senate, the President-Justice and the Premier.


The Executive Council


I: The Executive Council is chartered as the executive branch of The Democratic Alliance, thereby being granted the responsibility to, as a united council, organize and manage the government on behalf of the citizenry under the oversight of the Founder.

II: The Executive shall compose of 5 ministers, elected by the Senate every 2 months: the Premier of the Alliance, the Secretary of the Interior, the Chairman of Justice, the General of Defense and the Chief Ambassador.

III: The Premier of the Alliance shall serve as Head of State and is responsible for the general administration of the region, including collaborating with the General of Defense and Chief Justice to protect The Democratic Alliance and its allies, partnering with the Secretary of the Interior to manage internal affairs, ensuring the proper administration of the Senate and fairly influencing policy in the best interests of the region.

IV: The General of Defense shall serve as Head of the region's armed forces, providing for the defense of the Alliance and its allies, as well as collaborating with the Chairman of Justice to apprehend accused and convicted lawbreakers.

V: The Secretary of the Interior is responsible for managing the internal operations of the Alliance, including resolving civil conflicts, enforcing the rights and responsibilities of citizens and granting and repealing citizenships.

The International Court


I: The International Court is established as the judicial organ of The Democratic Alliance, thereby being granted the authority to judge civil and criminal lawsuits and administer appropriate punishment, when needed.

Rights and Responsibilities of Citizens


I: All citizens are granted the right to vote in all official elections, regardless of their personal beliefs, bodily or mental characteristics, or previous actions for or against the region.
