The Official Oaths Act, 2024
Sections
BE it enacted by the Parliament as follows:—
1. Short Title.— (1) This Act shall be henceforth referred to as the "The Official Oaths Act, 2024."
2. Administration of Oaths.— (1) The Election Commission shall be vested with the obligation to administer all the Oaths for all elected Candidates for the Jana Sabha and the candidates who are contesting in the elections in accordance with this Act given that the office of Prime Minister shall be an exception to this.
(2) The President shall be vested with the obligation to administer all the Oaths for the Prime Minister. their Council of Ministers and the Speaker of Jana Sabha, in accordance with the provisions of this Act.
(3) The Speaker of Jana Sabha shall be vested with the obligation to administer all the Oaths for the Deputy Speaker of the Jana Sabha, in accordance with the provisions of this Act.
(4) The President shall be vested with the Obligation to administer all the Oaths for the Judges of the Court, in accordance with the provisions of this Act.
(5) The Chief Justice of India shall be vested with the Obligation to administer all the Oaths for the President of India and the Chief Election Commissioner of India, in accordance with the provisions of this Act.
(6) The Ministers in the Council of Ministers shall be vested with the Obligation to administer all the Oaths for their Deputies and every single civil servant working within the Government, in accordance with the provisions of this Act.
(7) The Judges of the Court shall be vested with the Obligation to administer all the Oaths they deem indispensable for a case within the court, in accordance with the provisions of this Act.
(8) The President shall be vested with the Obligation to administer all the Oaths for the Regional Territorial Governor, in accordance with the provisions of this Act.
(9) The President and the Council of Ministers shall be vested with the Obligation to administer all the Oaths for new citizens, in accordance with the provisions of this Act.
(9) The Judge/Judges for the Court Martials shall be vested with the Obligation to administer all the Oaths they deem indispensable for a case within their court, in accordance with the provisions of this Act.
3. Forms of Oath and Truth.— (1) All oaths and affirmations made under section 2 shall be
administered according to the forms given in this Act as may be appropriate to the circumstances of the case.
(2) Every nation giving evidence on any subject before any court or person required to administer oaths and affirmations shall be bound to state the truth on such subject.
(3) Every nation taking the Oath of an Office shall be bound to abide by their Oath.
4. Proceedings and evidence not invalidated by omission of oath or irregularity.— No omission to take any oath or make any affirmation, no substitution of anyone for any other of them, and no irregularity whatever in the administration of any oath or affirmation or in the form in which it is administered, shall invalidate any proceeding or render inadmissible any evidence whatever, in or in respect of which such omission, substitution or irregularity took place, or shall affect the obligation of a witness to state the truth.
5. Repeal.— The First Addendum of the Consitution shall be repealed.
Addendum I: Forms for Oaths of Office.— 1. Form of Oath of Office for the Prime Minister for the Region of India;
"I, [name], do [solemnly affirm/swear in the name of God] that I will bear true faith and allegiance to the Constitution of India and faithfully discharge my duties during my term as Prime Minister for the Region, and that I will uphold the ideals of Democracy, Freedom and Integrity of the Region of India, and that I will do right to all manner of people in accordance with the Constitution of India and the law, without fear or favour, affection or ill-will. As such, I hereby take up the office of the Prime Minister, with all the power, rights and responsibilities held therein. Jai Hind!"
2. Form of Oath of Office for a Minister for the Region of India;
"I, [name], do [solemnly affirm/swear in the name of God] that I will bear true faith and allegiance to the Constitution of India and faithfully discharge my duties during my term as a Minister for the Region, and that I will uphold the ideals of Democracy, Freedom and Integrity of the Region of India, and that I will do right to all manner of people in accordance with the Constitution of India and the law, without fear or favour, affection or ill-will. As such, I hereby take up the office of the [position], with all the power, rights and responsibilities held therein. Jai Hind!"
3. Form of Oath of Office for a Member of Parliament for the Region of India;
"I, [name], do [solemnly affirm/swear in the name of God] that I will bear true faith and allegiance to the Constitution of India and faithfully discharge my duties during my term as a Member of Parliament for the Region, and that I will uphold the ideals of Democracy, Freedom and Integrity of the Region of India, and that I will do right to all manner of people in accordance with the Constitution of India and the law, without fear or favour, affection or ill-will. As such, I hereby take up the office of the Member of Parliament, with all the power, rights and responsibilities held therein. Jai Hind!"
4. Form of Oath of Office of the Speaker of the Parliament for the Region of India;
"I, [name], do [solemnly affirm/swear in the name of God] that I will bear true faith and allegiance to the Constitution of India and faithfully discharge my duties as the Speaker of the Parliament for the Region of India, and that I will uphold the ideals of Democracy, Freedom and Integrity of the Region of India, and that I will do right to all manner of people in accordance with the Constitution of India and the law, without fear or favour, affection or ill-will. I will not on any account whatsoever divulge any matters of state brought under my consideration as the Speaker of Parliament for the Government of India. As such, I hereby take up the office of the [position], with all the power, rights and responsibilities held therein. Jai Hind!"
5. Form of Oath of Office of the Chief Justice (or judge) for the Region of India;
"I, [name], having been appointed as a/the [position] of the Court of India do [solemnly affirm/swear in the name of God] that I will bear true faith and allegiance to the Constitution of India as by law established, that I will uphold the sovereignty and integrity of India, that I will duly and faithfully and to the best of my ability, knowledge and judgment and perform the duties of my office without fear or favour, affection or ill-will and that I will uphold the Constitution and the laws. Jai Hind!"
6. Form of Oath of Office of the Chief Election Commissioner for the Region of India;
"I, [name], do [solemnly affirm/swear in the name of God] that I will bear true faith and allegiance to the Constitution of India and faithfully discharge my duties as the Chief Election Commissioner for the Region of India, and that I will conduct elections in a fair, transparent, unprejudiced, impartial manner and that I will do right to all manner of people in accordance with the Constitution of India and the law, without fear or favour, affection or ill- will. I will not on any account whatsoever divulge any information brought under my consideration as the Chief Election Commissioner for the Region of India. As such, I hereby take up the office of the Chief Election Commissioner, with all the power, rights and responsibilities held therein. Jai Hind!"
7. Form of Oath of Office of the Regional Territorial Governor for the Region of India;
"I, [name], do [solemnly affirm/swear in the name of God] that I will bear true faith and allegiance to the Constitution of India and faithfully discharge my duties as the Governor for the Region of India and it's peripheral regions, and that I will uphold the ideals of Democracy, Freedom and Integrity of the Region of India and it's peripheral regions, and that I will do right to all manner of people in accordance with the Constitution of India and the law, without fear or favour, affection or ill-will. I will not on any account whatsoever divulge any matters of state brought under my consideration as the Governor for the Region of India and its peripheral regions. As such, I hereby take up the office of the Governor, with all the power, rights and responsibilities held therein. Jai Hind!"
8. Form of Oath of Office of an Official serving, in the Government of India;
"I, [name], do [solemnly affirm/swear in the name of God] that I will bear true faith and allegiance to the Constitution of India and faithfully discharge my duties as an Official for the Government of India, and that I will uphold the ideals of Democracy, Freedom and Integrity of the Region of India, and that I will do right to all manner of people in accordance with the Constitution of India and the law, without fear or favor, affection or ill-will. I will not on any account whatsoever divulge any matters of state brought under my consideration as an Official for the Government of India. As such, I hereby take up the office of the [position], with all the power, rights and responsibilities held therein. Jai Hind!"
Addendum II: Oaths of Secrecy.— 1. Form of Oath of Secrecy for the Prime Minister for the Region of India;
"I, [name], do [solemnly affirm/swear in the name of God] that I will not on any account, at any time whatsoever, disclose any information, matters of state which shall be brought under my consideration or shall be known to me as the Prime Minister for the Region except as may be required as the due discharge of duties as the Prime Minister. Jai Hind!"
2. Form of Oath of Secrecy for a Minister for the Region of India;
"I, [name], do [solemnly affirm/swear in the name of God] that I will not on any account, at any time whatsoever, disclose any information, matters of state which shall be brought under my consideration or shall be known to me as a Minister for the Region except as may be required as the due discharge of duties as a Minister for the Region. Jai Hind!"
3. Form of Oath of Secrecy for a Member of Parliament for the Region of India;
"I, [name], do [solemnly affirm/swear in the name of God] that I will not on any account, at any time whatsoever, disclose any information, matters of state which shall be brought under my consideration or shall be known to me as a Member of Parliament for the Region except as may be required as the due discharge of duties as a Member of Parliament for the Region. Jai Hind!"
Addendum III: Oaths in Judicial Proceedings.— 1. Oath or Affirmation for Witness;
I do (swear in the name of God/solemnly affirm) that what I shall state shall be the truth, the whole truth and nothing but the truth.
2. Oath or Affirmation for Affidavits;
I do (swear in the name of God/solemnly affirm) that this is my nation's name and signature (or mark) and that the contents of this affidavit are true in their entirety.
Addendum IV: Other Oaths.— 1. Form of Oath of Citizenship for the Region of India
"I, [name], pledge loyalty to the Region of India, obedience to her laws, and responsible action as a member of her society. I pledge to only register one nation as a citizen in India. I pledge that no nation under my control will wage war against the Region of India and that I will take this oath freely without any mental reservation or purpose of evasion. Jai Hind!"
2. Form of Oath of Allegiance for any person enlisting in the Armed Forces of India;
"I, [name], do [solemnly affirm/swear in the name of God] that I will support and defend the Constitution of India against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of India and the orders of the officers appointed over me, according to regulations and the Military Code of Conduct. Jai Hind!"
3. Form of Oath or Affirmation for a Candidate contesting in any elections for the Region of India;
“I, [name], having been nominated as a candidate to fill a seat in the executive/legislature do [solemnly affirm/swear in the name of God] that I will bear true faith and allegiance to the Constitution of India as established by law, and that I will uphold the sovereignty and integrity of India. Jai Hind!”
