Updated Criminal Code of 21FCR

Update of the Criminal Code of 21FCR

The Meta Committee,
Recognizing that the people of Rome work hard;
Desiring to update the Criminal Code so that it may be applicable to the region’s current context;
Upon approval of a vote of Patricians;

Declares the following to be affirmed as law of 21st Century Rome (hence to be referred to as 21FCR)

Part I - Jurisdiction

  1. In this Code, unless otherwise stated, "21FCR" shall mean all official means of communication for the region.

  2. This Code shall apply to 21FCR.

  3. This Code shall apply to communications to, or from, citizens of 21FCR.

  4. No one, regardless of current position in the region shall be exempt from these provisions, excluding the Imperator and, in his absence, the Dictator.

  5. The Imperator and, in his absence, the Dictator, can unilaterally extend the punishment of a criminal found to be guilty.

  6. Charges shall not be pressed when the victim of a crime does not wish it to happen, barring cases in which the transgression was committed in the RMB or the regional Discord.

  1. Any person who attempts to commit an offence shall be held liable as though they did in fact commit the offence.

  2. Any person who conspires with another person to commit an offence shall be held liable as though they did in fact commit the offence.

  1. This Code is meant to be utilized as a guide for 21FCR moderators in any area previously described in Section 1.

  2. The offences contained in this Code shall be criminal offences triable before the Imperator, or Dictator, of Rome.

  3. Upon conviction for any criminal offence, a criminal shall be liable to be banned from 21st Century Rome, in the most severe cases, or ordered to complete any other punishment which may be deemed appropriate by the judge.

  4. If this Code does not specify a minimum sentence upon conviction then the sentence shall be at the discretion of the judge, provided that it shall be proportionate to the crime and the criminal's level of involvement.

  5. Unless otherwise specified by this Code, all punishments delivered by regional mods, barring the Imperator and, in his absence, the Dictator, require mod consensus.

  6. Conviction for any of the crimes listed in this code shall happen in one of two ways:

    1. By a unilateral determination from the Imperator and, in his absence, the Dictator.

    2. By recommendation from mod consensus to the Imperator and, in his absence, the Dictator.

  1. A term is defined as the period between common elections.

Part II - Offences Against Regional Security

  1. A person is guilty of treason if they attempt to undermine the continued existence of Rome, or if they aid or support, in any manner, a region with which Rome is at war.

  2. The sentence upon conviction for treason shall not be less than a one month ban.

  1. A person is guilty of espionage if they disclose to an unauthorized person, or obtain in order to disclose to an unauthorized person, confidential or sensitive government information.

  2. The sentence upon conviction for espionage shall not be less than a three week ban.

  1. A person is guilty of sabotage if they act in a way that is likely to cause harm to Rome or her interests.

    1. Crossrecruitment, that is to say, actively attempting to recruit or drive away citizens of 21FCR to another region, shall be considered as a crime under this section.

      1. The above must happen within 21FCR's public forums (the RMB and Discord server) to be considered crossrecruitment.

  2. The sentence upon conviction for sabotage shall not be less than a three week ban.

  1. A public official is guilty of corruption if they use the powers of their office as a means to further their personal interests or those of their allies.

  2. The sentence upon conviction for corruption shall be removal from public office and a ban on holding any public office for 2 terms.

  1. A moderator of either the discord server or NationStates region of 21FCR is guilty of abuse of administrative powers if they, without mod consensus, approval by the Imperator or the Dictator, or the due authorization of the law:

    1. intentionally ban a citizen from the region, or

    2. intentionally deletes or hides any lawfully-made posts.

    3. perform official actions outside of the description of their public office

  2. The sentence upon conviction for abuse of administrative powers shall not be less than removal of administrative powers and a ban from running for any office for one term

  1. A person is guilty of impersonating an official if they present themself as holding a governmental office or other official authorization or sanction which they do not in fact hold.

  2. The sentence shall be a ban from holding office for one term

Part III - Offences Against the Public Order

  1. A person is guilty of trolling if they send or post, in public or in private, grossly offensive material, or material that is so vexatious as to be likely to cause harm to the regional peace.

  1. A person is guilty of harassment if they send or post material, in public or in private, with the likely intent to cause distress to another person.

  1. A person shall be guilty of discrimination if they, by action or by omission, intentionally or unintentionally, exclude or act against another citizen of 21FCR because of their ethnical origin, their skin colour, their nationality, their gender, their sexual preference, their religion (or lack thereof), or any other reason not considered within this document.

    1. Discrimination can overlap with Harassment when done intentionally.

    2. If done unintentionally, the offender shall be asked to reflect on their behaviour and apologize to the offended party, lest they be barred from holding public office.

  1. A person is guilty of making obscene communications if they communicate, in any way whatsoever, any material which would normally not be included in a PG-13 movie (ie. Pornographic imagery, extreme violence, etc.)

  1. A person (A) is guilty of violation of privacy if they reveal any real-life personal information about another person (B) without B's consent.

  2. There shall be no offence if B later accepts that A should not be criminally liable for the revelation.

  3. The sentence upon conviction for violation of privacy shall not be less than a four week ban.

  1. A person is guilty of blackmail if they use private information about another person in order to intimidate, distress or otherwise harm that person.

  2. The sentence upon conviction for blackmail shall not be less than a four week ban.

Part IV - Offences Against Justice

  1. A person is guilty of perjury if they deliberately lie or give false or fabricated evidence to the mods, the Imperator, and/or the Dictator.

  1. Contempt of court is the offense of being disobedient to or disrespectful towards the determinations of the mods, the Imperator and/or the Dictator.

  2. The punishment shall be no less than a one week ban.

Part V - Residual Powers

  1. Where an administrator or moderator is made aware of material that they believe constitutes spam, or is grossly offensive or obscene, they may hide such material from public viewing without obtaining permission from the Imperator, the Dictator, and/or mod consensus, if and only if NS moderation/Discord TOS would deem that material inappropriate. The appropriate authorities (either NS mods or Discord mods) must immediately be contacted, and if they have not removed it within 12 hours, it must be unsuppressed (in the case of Discord, any punishment given because of it must be lifted).

  2. An administrator or moderator exercising their powers under subsection 18.1 shall immediately notify any member whose material they have hidden.

  3. Any material that is hidden in accordance with subsection 18.1 may not be deleted for 48 hours and must be made available upon demand for review by the Imperator or the Dictator. The material may be deleted after 48 hours have elapsed and the act of hiding has not been challenged.

  4. Where an administrator believes that a member of Rome is solely in Rome for the purpose of spamming, they may ban, without mod consensus, such a member.

  1. Where an administrator reasonably believes that a real-life crime has been committed, they may hide or delete any posts related to that real-life crime and may ban, without mod consensus, any person whom they suspect of committing that real-life crime.

  1. Any actions by a player which break NS rules and/or Discord TOS fall under the jurisdiction of the appropriate authorities and must be reported to the moderators to deal with according to the site’s rules, including any applicable sections of this code.

This document shall be implemented as soon as it is approved.
