The Wonderful Empire of Pedriuni Legislation

The Wonderful Empire of Pedriuni is ruled by a simple and short constitution. The authorities have limited powers and the people have a lot of rights. The basis theory of the state is founded in the three principles of liberalism: Life, Freedom, Property. The state functions are just to protect and guarantee these three principles. MAGNA CARTA

Written by His Majesty Emperor Bruno Lucas Peroni, with the presence of the founding fathers Archduke Érico Monte Martínez and Archduke Pedro Artur Simões da Silva. Granted in 2023 by the Imperial Assembly.

EXORDIVM

We, the Founding Fathers, together with the people of the Wonderful Empire of Pedriuni, in search of freedom, prosperity and justice, and based on the principles of Liberalism, established this Constitution to guide our Empire in harmony with the values ​​of Life, Freedom and Property.

CAPITVLVM I - DE RE PUBLICA

Article 1 - Fundamental Principles:

The Wonderful Empire of Pedriuni is based on the principles of Life, Liberty and Property, with the utmost importance given to Life, followed by Liberty and, finally, Property. These principles guide and base all the Empire's actions and policies.

Article 2 - Parliamentary Constitutional Monarchy:

The Wonderful Empire of Pedriuni is a parliamentary constitutional monarchy, with the monarch playing the role of Moderating Power and the Imperial Assembly as the executive body. The monarch exercises his power in accordance with this Constitution and the laws of the Empire.

Sole Paragraph: Members of the nobility, appointed by the Emperor, based on their merits, represent the Moderating Power in the imperial federative divisions.

Article 3 - Federative Division:

The Empire is made up of four Regional Kingdoms: North, South, East and West, each subdivided into Provinces, Counties and Baronies, with administrative autonomy within the limits of this Constitution and imperial laws.

Sole Paragraph: all Pedriunian imperial territory is indissoluble and must maintain loyalty to the crown.

CAPITVLVM II - POTESTATVM

Article 4 - Executive Power:

Executive power is exercised by the Imperial Assembly, made up of 11 members of Parliament. They are responsible for the administration of the Empire and the implementation of public policies.

§1 In provincial, county and baronial territories, the head of the local executive power is appointed by the respective local parliament.

§2 The heads of the executive powers of the Regional Kingdoms are the Regional Kings themselves.

§3 The heads of executive powers are called:

a. President of the province (provinces);

b. Viscount (counties);

c. Baronet (baronies).

Article 5 - Legislative Power:

Legislative power is exercised by Parliament, made up of 127 deputies and 41 senators, elected by the people. Parliament is responsible for creating and approving imperial laws, respecting the fundamental principles of this document.

§1° Each imperial jurisdiction (Regional Kingdoms, Provinces, Counties and Baronies) has a unicameral Parliamentary Assembly that exercises legislative power locally.

§2º The Parliamentary Assemblies are composed, at the regional, provincial, county and baronial royal spheres, respectively of:

a. Royal deputies;

b. Provincial deputies;

c. Councillors;

d. Delegates.

Article 6 - Judiciary:

The Judiciary Power is exercised by the Imperial Supreme Court, made up of 7 ministers appointed through a public competition, with the approval of Parliament. The Supreme Court is responsible for ensuring the fair and impartial application of imperial laws relating to the constitution.

§1: In addition to the Imperial Supreme Court, there are other lower courts, occupied by the following:

I - Royal Regional Courts

Primary Judges

Independent prosecutors

II - Provincial Courts

Secondary Judges

Independent prosecutors

III - County Court

Baronial Judiciary Board (composed of representatives of the popular assembly)

Judges

§2 All magistrates must act with complete impartiality, carefully observing the facts.

Article 7 - Moderating Power:

The Moderating Power is the key to every political organization and is delegated privately to the Emperor as Supreme Head of the Nation and Head of State in order to ensure the maintenance of the independence, balance and harmony of the other powers.

§1 The Emperor is responsible for:

I. Admit and dismiss state ministers;

II. Summon, extend, postpone and dissolve the Imperial Assembly and the Constituent Assembly, as well as sanction and veto their approved bills;

III. Nominate one of the candidates for senator from the triple lists of provinces. Being a senator per province;

IV. Grant amnesty, pardon and/or change of sentences imposed by the courts;

V. Suspend or dismiss magistrates;

VI. Represent the Empire abroad;

VII. Confer noble titles, honours and admissions to imperial orders, in addition to their respective special rights and duties, according to the merit of citizens;

VIII. Ensure compliance with the Constitution and laws as well as the security, prosperity and well-being of the Empire.

CAPITVLVM III - IVRIVM

Article 8 - Individual Rights and Freedoms:

All citizens of the Wonderful Empire of Pedriuni have the right to life, liberty and property. These rights may not be violated or limited except in accordance with the law and due process.

Sole paragraph: The right to life is inalienable in any form. Its violation entails the alienation of all other fundamental rights.

Article 9 - Procedural Guarantees:

All citizens have the right to a free and fair trial, presumption of innocence and adequate defense. Torture and inhuman or degrading treatment are strictly prohibited.

Article 10 - Constitutional Amendments:

This Constitution can only be amended through a legislative and transparent process, with the approval of the majority of members of Parliament and the ratification of the monarch.

Sole paragraph: the Emperor may convene the Constituent Assembly, composed of the Parliament and the Imperial Assembly united, to establish constitutional appendices (developments that specify articles) and/or propose another Magna Carta. The Emperor does not need ratification to add constitutional articles or appendices.

Article 11 - Constitutional Supremacy:

This Constitution is the supreme law of the Wonderful Empire of Pedriuni, and all laws and government actions must be in accordance with its principles and provisions.

This Constitution, based on Liberalism and the principles of Life, Liberty and Property, is the foundation of our Wonderful Empire, ensuring the individual freedom and well-being of our citizens.
