Pearl Land - Laws System

The Laws System in Pearl Land

Citizens are subject to a variety of laws made by the federal government, the state, city, or county. In general, all laws are part of a hierarchy in which federal laws are at the top, state laws are in the middle, and local laws at the bottom.

The Constitution

The Constitution is the supreme law of the land, and is the top part of the federal laws. All other laws subject to follow and not-to-violate the constitution.

Federal Laws

The federal laws (also known as statutes), enacted by the USPL (United States of Pearl Land) Congress, must be followed by every state in the country. If a state law contradicts a federal law, the federal statute preempts the state law, and the state will be required to abide by the federal statute. However, federal laws do not cover all areas of the law, and in those instances, state or local laws will control.

State Laws

Similarly, within a state, the state constitution represents the highest legal authority. The state may then enact state statutes, which apply to everyone within the state. State statutes cannot violate the state constitution, the federal constitution, or federal law.

The term “statute” simply refers to a law enacted by a legislative body of a government, whether federal or state.

Local Ordinances (Local Laws)

Just as a state may delegate the authority to make regulations to administrative agencies, it may also delegate certain powers to other units of government within the state. County and municipal governments enact laws, often called ordinances, via specific powers granted to them by the state. County and municipal ordinances apply to everyone within the county or municipality limits. These ordinances may not violate state or federal laws.

The System of Checks and Balances

The system of Checks and Balances, combined with a clean and clear constitution, it creates a guarantee for democracy. A system of Checks and Balances is a promise of democracy. The system of checks and balances is a very important part of the Constitution and an essential part of a healthy legislature. With checks and balances, each of the three branches of government (executive, judicial, and legislative) can limit the powers of the others. This way, no one branch becomes too powerful. Each branch “checks” the power of the other branches to make sure that the power is balanced between them. A good example, is the verification that the judicial branch makes to the legislature before a law gets officially active. This system also stops the president from being too powerful, so nobody can take full control of the country.

The Legislative System

Our government is by the people, and for the people.

All the people of our country, everybody is already part of this system of legislature. All the concerns of the people, all the ideas, all the complaints, all of that, it is being listened, because all of you are represented in the house of representatives, and the senate. Our representatives and senators, they are waiting to listen for you.

Also we understand that the compromise of our representatives, and senators, goes even beyond of serving the people, because they are people that are constantly working hard, researching all those things that are convenient for you, for our nation, for the civil rights. All those accomplishments that we can proudly mention now, it's because of the compromise and hard work, including the hard work of an elite group of persons that have been carefully elected by you, by the people.

People can choose who will represent them, who will work for them, who will fight for them in the house of representatives, and the senate!

So all the people take an important part in the legislature system already! The people elect the people that formulate the laws! The people elects the people that governs the country.
